Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Morning Pushups mobile application (the "App") operated by Substruct LLC ("we," "our," or "us").

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial use.

3. Restrictions

You agree not to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or other proprietary notices
• Use the App for any illegal purpose or in violation of any laws
• Sell, rent, lease, or sublicense access to the App

4. In-App Purchases

The App offers optional tipping for the developer. All purchases are:

• Processed by Apple through the App Store
• Subject to Apple's Terms of Service and payment policies
• One-time, non-subscription purchases
• Non-refundable except as required by applicable law or Apple's refund policy

Purchased sound packs are tied to your Apple ID and can be restored on your devices at no additional charge.

5. Intellectual Property

The App, including all audio recordings, code, design, graphics, and content, is owned by Substruct LLC and protected by copyright, trademark, and other intellectual property laws.

The audio recordings included in the App are licensed for use solely within the App. You may not extract, reproduce, or use these recordings outside of the App.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Any defects will be corrected
• The App will meet your requirements

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUBSTRUCT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, or other harmful code that may be transmitted through the App
• Any errors or omissions in any content

8. Apple Device Requirements

The App requires:

• Apple Watch Series 4 or later running watchOS 10 or later
• iPhone running iOS 17 or later (for companion features)

Functionality may vary based on device capabilities and settings.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Effective Date" and, where appropriate, providing notice in the App. Your continued use of the App after changes constitutes acceptance of the modified Terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms. Upon termination, your license to use the App ceases immediately.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
